 INFORMED CONSENT FOR USE OF AUDIO RECORDING, GENERATIVE AI, AND PROCESSING OF SENSITIVE RECORDS

In connection with this matter, the Firm may collect information, as well as audibly and through video record interviews or meetings, transcribe recordings using secure artificial intelligence tools, use artificial intelligence tools to review, summarize, analyze, or synthesize records and information, and use technology that identifies or distinguishes speakers within recordings. These tools are used solely to assist in preparing legal reports, court filings, memoranda, and related legal work.

In performing court-appointed duties, the Firm may review and process sensitive records, including psychological evaluations, therapy records, psychiatric treatment records, substance abuse treatment records, medical records, and records concerning minor children. Artificial intelligence tools may be used to assist in reviewing, summarizing, or organizing such records when necessary for legal analysis. Such processing is limited to purposes directly related to the legal representation or court appointment.

If speaker-identification technology is used, your voice may be processed in a manner that creates or utilizes a biometric identifier (such as a voiceprint), as defined by the Illinois Biometric Information Privacy Act (740 ILCS 14). If collected, biometric identifiers will be used only to distinguish speakers and prepare accurate transcripts. They will not be sold, leased, traded, or otherwise profited from by this attorney. They will not be disclosed by this attorney except as required in legal proceedings or permitted by law. They will be stored using reasonable security safeguards.

Biometric identifiers or biometric information, if any, will be retained only until the purpose for collection has been satisfied, or three (3) years after your last interaction with the Firm, whichever occurs first. After that time, biometric identifiers will be permanently destroyed in accordance with the Firm's written retention schedule. Attorney work product, transcripts, court filings, and case materials may be retained consistent with professional responsibility obligations. Attorney is not responsible for any breaches from third party entities.  Basic video and audio, as well as transcripts, are not considered biometric information.

The Firm maintains reasonable administrative, technical, and physical safeguards to protect personal and sensitive information, including encrypted storage systems, secure cloud-based platforms, multi-factor authentication, and restricted access controls. This firm is not responsible for data breaches from third party entities. 

You acknowledge that you understand that sensitive personal and mental health information may be processed using artificial intelligence tools, you understand the purpose and limits of such processing, you have received notice regarding potential biometric processing, you understand the retention and destruction policy, you have had the opportunity to ask questions, and you voluntarily consent to the use of artificial intelligence tools as described for all video and audio recordings, as well as any information obtained through information you have disclosed, as well as any legal pleadings. You may revoke this consent in writing.
